CPT 99401, 99402, 99403 and 99404: can dietitians bill them?

The short answerCPT 99401-99404 are preventive medicine counseling codes for one person, at about 15, 30, 45 and 60 minutes (99404 is the 60-minute code). They sit in CPT's evaluation and management section. Medicare doesn't pay them, and UnitedHealthcare's policy says registered dietitians shouldn't bill them. Most dietitians should bill 97802/97803 unless a payer's contract says otherwise.

99404 shows up in dietitian forums for a simple reason: a colleague said a payer paid it, or a denial on 97802 sent someone looking for another code. Before you add 99401-99404 to a superbill, it helps to know what these codes are, who they're built for, and what the major payers actually say.

The four codes and their time

CPT describes the family as preventive medicine counseling and/or risk factor reduction intervention(s) provided to an individual, and each code carries an approximate time:

Unlike 97802/97803, you don't bill units. You pick one code for the encounter, the one whose typical time is closest to the face-to-face time. The "closest typical time" rule is how many payers handle sequential time codes; North Dakota Medicaid's claims guidance states it plainly.

The group versions are 99411 and 99412.

Who typically bills them

These codes sit in CPT's evaluation and management (E/M) section, among the preventive medicine services. The clinicians who normally report them are physicians and other practitioners who can bill E/M: nurse practitioners, physician assistants, clinical nurse specialists. The counseling is meant for risk reduction in people without an established illness, like diet and exercise counseling during a preventive visit. Counseling for a condition the patient already has is usually reported with other codes.

That E/M placement is the whole story for dietitians. Many payers don't let nonphysician professionals report E/M codes, and a registered dietitian is a nonphysician professional in those policies.

Can a dietitian bill 99401-99404?

It depends on the payer. Here's what the published policies say:

99401 vs 97802: which one the payer wants

Preventive policies often list both families side by side. UnitedHealthcare's Preventive Care Services policy (effective July 1, 2026) puts "Medical Nutrition Therapy or Counseling: 97802, 97803, 97804, G0270, G0271" and "Preventive Medicine Individual Counseling: 99401-99404" in the same rows. The prediabetes row, for example, requires R73.03 and is limited to ages 35 to 70. Cigna's Preventive Care Services policy A004 lists 97802-97804 and S9470 in its nutrition and physical activity counseling rows, and 99401-99404 separately.

The practical rule for a dietitian:

  1. Default to 97802/97803. They describe what you do, they're the codes payers credential RDs for, and they appear in the same preventive rows.
  2. Use 99401-99404 only if your contract lists them for your specialty.
  3. Don't swap codes to rescue a denial. If 97802 was denied for a preventive visit, the fix is usually the diagnosis routing, not the procedure code. See preventive vs medical benefits.

Pairing with Z71.3 and risk codes

Whichever code family you bill, the diagnosis decides which benefit pays:

  1. Reimbursement: "Is a registered dietitian allowed to bill CPT 99401-99404 under my contract, or only 97802-97804?"
  2. Benefit: "For this member, is nutrition counseling covered under preventive or medical, and which diagnosis codes does the preventive benefit require?"
